What do you use to sell your photography...and why?

I know that there's a few threads that reflect similar questions, but really nothing seems to be definitive in terms of the best suggestions along with reasons. For the most part, there's really no awesome solution from what I can tell.

Some of the ones out there include
  • Zenfolio
  • SmugMug
  • PrintedArt
  • Flickr
  • Wordpress
  • Blogger
  • Concrete5
  • Custom website & eCommerce

I'm sure this list could go on...and on. But what do you use? Why? Have you ever tried something else?

I've been looking at a few (currently use flickr, but am probably going to transfer off). Flickr is great for sharing images, but not great for the business side of photography to be added in.

Your thoughts?

Re: What do you use to sell your photography...and why?

I bought a smugmug pro site and I did use it to sell my MC pics to the riders until the track got involved and told me I couldn't. I hear Zenfolio is a great site too.

Have you ever looked at the fine print on most tickets to places like zoos, seaworld, fairs of sorts, circus's. They all have one thing in common. A disclaimer specifically stating that photos take at the location during that visit cannot be sold.

The Race is a private venue and the legally able to restrict professional event photography to individuals they contract with providing exclusivety to a particular event.

Some of the dog venues I shoot charge a fee for shooting as a vendor. Anyone else shooting and selling is asked to leave. This does not mean that participants can't shoot their friend's dogs, but it means if you do pay you can't play.

In this case the track perhaps has its own team of professionals who they have granted exclusive rights to shoot and sell photos from the track. Nothing is stopping any one from shooting the action, only the selling part.

I can see them stopping you from selling them on premis, or giving out cards on where to purchase them. But if they welcome people onto their property with a camera, it's kind of hard to tell a person wha they can and can't do with the pictures after the fact. Well baring the normal restrictions of copywrited material (ie a play or performance of some kind) or a trademarked building, and releases on recognizable people. But getting a motorcycle on just a section of track with a blurry background? I don't think that would hold up.

First you will receive a cease and desist letter on selling. Basically if you conintue to sell photos (taken at the event for which the letter was received), you will be sued. On top of that you can be barred as a spectator from the event.

That is what happened to me. They contacted me and told me I had to stop selling them or get a Vendors license AND Filming insurance or I won't be welcome at the track anymore. I sign a disclaimer while entering the premises and it does say that though I can take pictures for private use I may not sell them. At first I thought I couldn't go back unless I got the license and insurance but when I asked them they said I could continue to take pictures as long as I don't sell them. They found my website and saw that I was indeed selling them.

Last year at comicon they had an interesting seminar on copyright...I was the only non-lawyer in the class. They had people that worked for Disney and other such companies. What is realy interesting is Shats containing company logos and other trademarks.

Depending on the sale usage one can also be sued based on trademakr dillution and such just because you present a tradmark in a less than flattering way for the owner of the trademark, Somewhere in a closet I have a nice handout of all the legal mumbo jumbo.

It was a seminar well worth taking as a photographer and has made me more aware of backgrounds for photos I intend to sell.
